►1. Primary place of practice and regulatory disclosure

Fernando del Canto is a multi-jurisdictional legal practitioner. Depending on the nature of the work undertaken, he is subject to the professional rules and oversight of the following bodies:

  • Republic of Ireland: Registered European Lawyer (REL), registered with the Law Library (The Bar of Ireland).

  • England & Wales: Barrister, regulated by the Bar Standards Board (BSB).

Fernando del Canto’s primary residence and principal place of practice is the Republic of Ireland, where he practises as a Registered European Lawyer (REL) registered with the Law Library (The Bar of Ireland).

The applicable professional rules, client protections, complaints routes and regulatory obligations depend on:

(i) the jurisdiction of the legal work (Ireland / England & Wales / Spain),

(iii) the forum in which any advocacy or advice is provided.

►2. Trading names and service arrangements

Fernando del Canto provides legal services under the commercial names Del Canto Chambers and DC Chambers.

Administrative, clerking, invoicing and (where applicable) fee-collection services are coordinated through DC Governance & Professional Practice Advisory (Ireland) Ltd (Company No. 676141; Registered Office: Fitzwilliam Hall, Fitzwilliam Place, Dublin 2), which acts solely as a service provider and administrative agent.

This company is not an incorporated law firm and does not provide legal advice. All legal advice, advocacy and professional responsibility are provided personally by Fernando del Canto as a self-employed practitioner within his respective professional capacities.

► 3. Scope of services and jurisdictional capacities (“regulatory hats”)

This website describes a cross-border practice. Instructions may involve:

  • Irish law and/or proceedings in Ireland;
  • English law and/or the jurisdiction of England & Wales;
  • Spanish law and/or proceedings in Spain; and
  • Multi-jurisdictional matters, including conflicts of law, enforcement of judgments, international tax, trusts and estates, governance, and cross-border disputes.

Where a matter requires advice or representation outside Fernando del Canto’s professional authorisation, he may recommend or collaborate with appropriately qualified local counsel, subject to conflicts checks and client consent where required.

► 4. England & Wales disclosures (Bar Standards Board)

For legal services provided under English law and/or within the jurisdiction of England & Wales, Fernando del Canto practises as a self-employed barrister regulated by the Bar Standards Board (BSB).

Where permitted, clients may be able to instruct him directly under the Public Access scheme.

► 5. Professional indemnity insurance

Fernando del Canto maintains professional indemnity insurance in accordance with the applicable professional requirements of the jurisdictions in which services are provided, including (where relevant) cover associated with:

  • the Law Library / Bar of Ireland,
  • the Bar Standards Board arrangements (including BMIF) in England & Wales, and
  • ICAM requirements in Spain.

Details of insurance cover, including territorial scope and insurer particulars, are available to clients upon written request.

► 6. Client engagement and terms of business

6.1 No lawyer–client relationship unless confirmed

Accessing this website or making contact does not create a lawyer–client relationship. Such a relationship arises only once:

  1. conflicts checks have been completed and cleared;
  2. a written engagement letter / client care letter has been issued and accepted; and
  3. any required funds on account have been received (where applicable).

6.2 Conflicts of interest

All instructions are subject to conflicts checks. Fernando del Canto may be unable to act where a conflict exists or may arise, including where duties of confidentiality prevent disclosure of relevant information.

6.3 Fees and billing

Fees are agreed in writing and may be structured as hourly rates, fixed or staged fees, retainers, or other agreed arrangements. The engagement letter will set out:

  • the scope of work and assumptions;
  • the charging basis and applicable taxes (if any);
  • billing frequency;
  • funds on account; and
  • responsibility for disbursements and third-party costs.

6.4 Disbursements and third-party services

Disbursements (including court fees, experts, translators, travel, filings and process servers) are payable by the client. Certain services may require the client to contract directly with third parties.

6.5 Confidentiality and privilege

Confidentiality is observed in accordance with applicable professional rules and the governing law of the engagement. Legal professional privilege may apply depending on jurisdiction and context and may differ between Ireland, England & Wales and Spain.

6.6 Anti-money laundering and due diligence

Instructions may be conditional upon completion of client due diligence and AML checks, including verification of identity, source of funds and source of wealth where required by law or regulation.

6.7 Electronic communications and cybersecurity

Electronic communications are used in the ordinary course of practice. While reasonable security measures are taken, no system is entirely risk-free. Clients should advise of any special security requirements.

6.8 Limitation of services

Unless expressly agreed in writing, services do not include accounting, bookkeeping, regulated financial services, investment advice, tax filing or compliance submissions, or company secretarial services.

6.9 Termination

Either party may terminate an engagement in accordance with the engagement letter and applicable professional obligations. Termination does not affect accrued fees or outstanding disbursements.
